1. Agreement to Terms

By accessing or using the AlpineDS platform ("Service") provided by DASC Products LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

The Service is a web-based construction scheduling platform that provides scheduling tools, dashboards, reporting, and data management capabilities for residential construction projects. The Service is provided on a subscription basis.

3. Accounts and Access

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payment

Subscriptions are billed monthly unless otherwise agreed. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. A one-time setup fee may apply for new client onboarding.

5. Data Ownership

You retain all rights to your data. We do not claim ownership of any data you upload or generate through the Service. Upon termination, you may export your data within 30 days. After that period, we may delete your data from our systems.

6. Service Availability

We target 99.5% uptime for the Service, excluding scheduled maintenance. We will provide reasonable notice of planned downtime. We are not liable for downtime caused by third-party services, force majeure events, or circumstances beyond our control.

7. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

Either party may terminate this agreement with 30 days' written notice. We may terminate immediately if you breach these Terms. Upon termination, your access to the Service will cease and you will have 30 days to export your data.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
